Terms of Use

1. What you are getting

Avelir is a client application built on Xray-core. It connects to servers you supply, through a subscription link you supply. It is not a VPN service. It comes with no servers, no traffic and no access of any kind, and none of those are sold here or inside it.

2. What it costs

Nothing. The application is free of charge and contains no purchases, no subscriptions and no paid tier. Whatever you pay your provider is between you and them, and no part of it reaches us through the application.

3. Your provider, and our relationship to them

The servers, the routing rules that arrive with a subscription, the expiry of your access and the amount of traffic left are all determined by whoever issued your link. We cannot see your account with them, cannot change it, and cannot help with it. Support questions about access go to them.

AdaptGroup LLC also operates VPN infrastructure that partner businesses resell under their own brands. Your subscription may or may not ultimately run on it; Avelir behaves identically either way, contains no address of ours, and gives no provider any advantage. Where your access does run on infrastructure we operate, your relationship is with the partner who sold it to you, under their terms — not under these, which cover the application.

4. Who may use it

You must be 18 or older. Use the application in accordance with the laws that apply to you and with the terms you agreed with your provider. We do not monitor your use and could not: there is no server of ours in the path.

5. What you may not do with it

Do not use Avelir to break the law where you are, to attack or disrupt other people's systems, or to circumvent the terms of the provider whose access you are using. Do not remove or alter the copyright and licence notices carried inside the application or its installers.

6. Third-party components

Avelir is built on open-source components. Every one of them is listed inside the application, under Settings → Licenses, with its licence and the address of its source, and in the THIRD-PARTY-NOTICES.md file distributed with the source release.

Two points of precision, because a general statement here would be inaccurate:

• Xray-core is used as an unmodified dependency at a pinned revision. Its source is the upstream project's, at that revision.
• libXray is used with our own additions: files we wrote and place alongside it during the build. The upstream files themselves are not altered. Both are licensed under the Mozilla Public License 2.0; the source of every file covered by that licence is the upstream project's, at the pinned revision named on the Licenses screen.
• Wintun, on Windows, is redistributed as the prebuilt signed DLL published by WireGuard LLC, under that company's Prebuilt Binaries License, whose text is installed alongside it. It is not modified and not repackaged.

Those licences govern those components; these terms govern the application as a whole.

7. Security, updates and how long we support a version

We will provide security fixes for Avelir for five years from the release of each version. If a vulnerability is found in Avelir, report it as described at avelir.app/security; we publish what was fixed once a fix is available.

Builds installed from Google Play or the App Store are updated by the store. Builds installed from avelir.app, GitHub Releases or the Windows installer check avelir.app for a newer version and tell you; they do not install anything by themselves.

8. Where builds come from

Builds are published on avelir.app, on GitHub Releases, and in the Google Play and App Store listings for app.avelir.vpn. Each build outside the stores carries its SHA-256 beside it. A build obtained anywhere else is not one we can vouch for, and we ask you to check the hash before running it.

9. Export control

Avelir contains cryptography and is subject to United States export law. You may not use or re-export it in violation of that law, including to any country or person subject to United States embargoes or trade sanctions.

10. What we do not warrant

The application is provided as it is. We do not warrant that a connection will succeed, that a given server will be reachable, or that the application will run without fault on every device — Android firmware from several manufacturers closes background services in ways no application can prevent, and that is described plainly on the site. To the extent the law allows, we are not liable for indirect or consequential loss arising from use of the application. Nothing here limits liability that cannot be limited by law, including for death, personal injury, or fraud.

11. Changes

These terms may change. The date at the top changes with them. Continuing to use the application after a change means accepting the new version.

12. Distribution through app stores

Where you obtained Avelir through the Apple App Store, your licence to use it is the one Apple applies to applications on that store, and Apple is not responsible for the application or for support of it; questions go to [email protected]. Where you obtained it through Google Play, the Google Play Terms of Service apply to that distribution. In either case these terms continue to describe the application itself and our relationship with you outside the store's own agreement.

13. Governing law, and language

These terms are governed by the laws of the State of Wyoming, USA. Nothing here deprives a consumer resident in the European Union of the protection of mandatory provisions of the law of their country of residence.

They are published in six languages; if a translation and the English version disagree, the English version governs.
